All payments are processed through Stripe. You agree to provide current payment information. Fees are non-refundable except as required by law.

We retain ownership of our marketing systems, methodologies, and content. You retain rights to your business data. We may use anonymized data to improve services.

6. Prohibited Activities

You agree not to:

• Engage in illegal activities or violate third-party rights
• Compromise system security or disrupt services
• Spam users or send unsolicited communications
• Reverse engineer any proprietary technology

7. Analytics and Tracking

We use Google Analytics and self-hosted Umami for performance tracking as described in our Privacy Policy.

8. Disclaimers

Services are provided "as is" without warranties. We don't guarantee specific marketing results. Third-party integrations are subject to their own terms.

9. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for indirect, incidental, or consequential damages arising from service use.

10. Termination

We may terminate access immediately for Terms violations. Upon termination, your right to use services ceases immediately.

11. Governing Law

These Terms are governed by Delaware law. Disputes will be resolved in Delaware courts.

12. Changes to Terms

We may modify these Terms with 30 days' notice. Continued use after changes constitutes acceptance.

14. SMS Program Terms

• Program description: Upon opting in to the SMS service, you can expect to periodically receive marketing messages from Tenor Creative. These messages are intended to be helpful. They may provide links to products or services. That we believe may be useful to your business.
• You can cancel the SMS service at any time. Simply text back "STOP". Upon sending "STOP," we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially, and we will resume sending SMS messages to you.
• If you experience issues with the messaging program, reply with the keyword HELP for more assistance, or reach out directly to support@tenorcreative.freshdesk.com.
• Carriers are not liable for delayed or undelivered messages.
• As always, message and data rates may apply for messages sent to you from us and to us from you. Message frequency varies. For questions about your text plan or data plan, contact your wireless provider.
